Because it's included in the modpack. We don't compose the packs, we just provide them so that you can play on them.
You may want to switch to forge for custom modding.

The resource pack is in a sub directory, but it must be in the top directory of the archive.
Also the pack definition file states that pack is for MC 1.9/1.10, so the pack will only work on these versions
